Mountaineer Race Track & Gaming Resort is an entergamement complex situated on the Ohio River in West Virginia. Established in 1951 as a horseracing venue, Mountaineer historically focused its operations on parimutuel wagering and related amenities. Following the 1995 passage of the Lottery Act, the company has repositioned the facility as a gaming destination resort and diversified entertainment facility. The company has substantially renovated and expanded Mountaineer, and has incrementally increased the number of slot machines as legislative developments either permitted or made their operation more profitable. The West Virginia state legislature has two sets of minimum and maximum payout limits depending upon the location of the gaming machine. Limited annual information is available on actual payout return statistics.

The Limited Video Lottery Act also imposed the state total of VLTs to 9,000 electronic gaming machines.

Further, the five to ten VLTs allowed at non-casino environments must obtain individual permissions to have a greater than 92% payout return. These so-called high payout terminals must twice obtain Commission approval including:
